1. Definitions & Interpretation
- "QP," "QualityProgressBD," "we," "us," "our" refers to the owners and operators of this Website, offering online training courses, consultancy services, digital products, and related educational content.
- "User," "you," "your" refers to any individual or entity accessing, browsing, registering on, or making a purchase through this Website.
- "Services" includes all online courses, training programs, consultancy sessions, digital downloads, certificates, webinars, coaching, and any other offerings made available on the Website.
- "Content" refers to all text, images, videos, audio, graphics, logos, software, course materials, and intellectual property displayed on the Website.
2. User Eligibility & Account Responsibility
- You must be at least 16 years of age to use this Website. Users under 18 must have parental or guardian consent.
- When creating an account, you agree to provide accurate, complete, and current information. You are solely responsible for maintaining the confidentiality of your login credentials.
- You are fully responsible for all activities that occur under your account. QP shall not be liable for any loss or damage arising from unauthorized access to your account.
- We reserve the right to suspend or terminate any account that violates these Terms, provides false information, or engages in fraudulent activity.
3. Purchases, Payments & Pricing
- All prices displayed on the Website are in Bangladeshi Taka (BDT) unless otherwise stated. International users may see approximate conversions for reference only.
- QP reserves the right to modify pricing, course fees, and consultancy rates at any time without prior notice. However, confirmed purchases will be honored at the price paid.
- Payment must be made in full at the time of enrollment or purchase. We accept payments through secure third-party gateways. QP does not store full credit card details on its servers.
- In the event of a payment dispute or chargeback initiated without valid reason, QP reserves the right to suspend access to all Services until the matter is resolved.
4. Refund & Cancellation Policy
- Our refund policy is governed by the separate Refund & Cancellation Policy published on the Website. By making a purchase, you agree to those terms.
- As a core principle: If a participant has completed 2 (two) training classes AND/OR 1 (one) full day of consultancy, the total fee becomes strictly non-refundable.
- Refund requests must be submitted in writing to qualityprogressbd@gmail.com with complete enrollment details and reason for cancellation.
- Approved refunds will be processed within 7-10 business days to the original payment method, subject to any applicable administrative charges.
5. Intellectual Property Rights
- All Content on this Website, including but not limited to course materials, videos, PDFs, logos, graphics, text, software, and design elements, is the exclusive intellectual property of QP or its licensors.
- Users are granted a limited, non-exclusive, non-transferable license to access and use the Content solely for personal, non-commercial educational purposes.
- The following actions are strictly prohibited:
- Downloading, copying, reproducing, or redistributing course materials without written permission.
- Sharing login credentials or allowing multiple users to access a single-paid account.
- Recording, screen-capturing, or distributing live or recorded training sessions.
- Using QP's name, logo, or branding without prior written consent.
- Violation of intellectual property rights may result in immediate account termination and legal action.
6. User Conduct & Prohibited Activities
- You agree not to use the Website for any unlawful purpose or in violation of any applicable local, national, or international laws.
- Prohibited activities include, but are not limited to: harassment of instructors or other users, uploading malicious code, attempting to breach security, scraping data, spamming, or impersonating others.
- Any form of cheating, plagiarism, or misrepresentation in assessments or certification processes will result in revocation of certificates and potential account termination.
- QP reserves the right to remove any user-generated content that violates these Terms without prior notice.
7. Privacy & Data Protection
- Your privacy is important to us. Our collection and use of personal data is governed by our separate Privacy Policy & Data Security page, which is incorporated into these Terms by reference.
- By using this Website, you consent to the collection and processing of your data as described in the Privacy Policy.

8. Disclaimer of Warranties
- The Website and all Services are provided on an "as is" and "as available" basis without any warranties, express or implied.
- QP does not guarantee that the Website will be uninterrupted, error-free, or free from viruses or harmful components.
- While we strive for accuracy, QP does not warrant that course content, descriptions, or other information on the Website is complete, current, or error-free.
- Educational outcomes and results vary by individual. QP makes no guarantees regarding employment, skill acquisition, or specific results from using our Services.
9. Limitation of Liability
- To the fullest extent permitted by law, QP, its owners, employees, instructors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or Services.
- QP's total liability for any claim arising from these Terms or the use of Services shall not exceed the total amount paid by you to QP in the 12 months preceding the claim.
- This limitation applies regardless of the theory of liability, whether contract, tort, negligence, strict liability, or otherwise.
10. Indemnification
You agree to indemnify, defend, and hold harmless QP, its owners, directors, employees, instructors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

- Your infringement of any third-party rights, including intellectual property or privacy rights.

13. Governing Law & Dispute Resolution
- These Terms & Conditions shall be governed by and construed in accordance with the laws of the People's Republic of Bangladesh.
- Any dispute arising from these Terms shall first be attempted to be resolved through amicable negotiation between the parties.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms & Conditions, together with our Privacy Policy, Refund Policy, and any other policies referenced herein, constitute the entire agreement between you and QP regarding the use of the Website and supersede all prior agreements, understandings, or representations.
